Planning a wedding is exciting, emotional and sometimes a little overwhelming. The good news is the legal process for getting married in Australia is actually very straightforward, especially when you have an experienced, registered marriage celebrant guiding you through it.

This page explains how to get legally married in Australia, what paperwork is required, the marriage timeline and exactly what your celebrant handles vs what you need to do.

How to Get Legally Married in Australia?

To be legally married in Australia, your ceremony must meet the requirements of the Marriage Act 1961 and be officiated by a registered Australian marriage celebrant.

To legally marry, you must:

  • Be at least 18 years old (unless legal approval has been granted)

  • Not be currently married

  • Freely consent to the marriage

  • Lodge a valid Notice of Intended Marriage

  • Have a ceremony conducted by an authorised celebrant

  • Say the required legal words during the ceremony

  • Sign marriage documents with two witnesses over the age of 18

The Notice of Intended Marriage, commonly referred to as the NOIM, is the most important legal document required to get married in Australia.

Key NOIM Requirements

  • Must be lodged at least one month before your wedding date

  • Can be lodged up to 18 months in advance

  • Must be signed in front of an authorised witness

  • Must be received by your celebrant before the legal timeframe

Once you book me as your marriage celebrant, I’ll provide the NOIM and guide you through:

  • How to complete it correctly

  • Who can witness it

  • How to lodge it if you are interstate or overseas

  • What to do if your wedding date is within the one month timeframe

In certain circumstances, a Shortening of Time may be granted. I’ll advise you honestly if this is an option and help with the process where applicable.
